The State of Texas County of Runnels I, M. Kleberg, Jr., County Judge of Runnels County, Texas, fo(sic) hereby certify that T. D. Bishop and J. T. Spain whose names appeared and were by them respectively signed to the within affidavits are credible and trustworthy citizens of this County and State. And I do further certify that the within named applicant, Mrs. Lucinda J. Johnston, has been a bona fide resident of the aforesaid County for a period of six months next before the date of this, her said application. Form B THE STATE OF TEXAS County of Runnels I, Mrs. Lucinda J. Johnston, do hereby make application to the Commissioner of Pensions for a pension, to be granted me under the Act passed by the Thirty-first Legislature of the State of Texas, and approved March 26, A.D. 1909 and amended by acts of 1913, on the following grounds: I am the widow of Samuel Johnston, deceased, who departed this life on the 20 day of Feby, A.D. 1901, in the county of Runnels, in the State of Texas I have not remarried since the death of my said husband, and I do solemnly swear that I was never divorced from my said husband, and that I never voluntarily abandoned him during his life, but remained his true, faithful and lawful wife up to the date of his death. I was married to him on the 16th day of Jany., A.D. 1855, in the county of Tallapoosa, in the State of Alabama. My husband, the said Samuel Johnston, enlisted and served in the military service of the Confederate States during the war between the STates of the United States, and that he did not desert the Confederate Service. I have been a resident of the State of Texas since prior to Jany. 1, A.D. 1900 and have been continuously since a citizen of the State of Texas. I do further state that I do not receive from any source whatever money or other means of support amounting in value to the sum of Three hundred dollars per annum, nor do I own in my own right, nor does anyone hold in trust for my benefit or use estate or property, either real, personal or mixed, either in fee or for life, of the value of one thousand dollars, exclusive of the home of the value over $1000; nor do I receive any aid or pension from any other State, or from the United States, or from any other source, and I do further state that the answers given to the following questions are true: 1. What is your age? 75 yrs October 1914 2. Where were you born? Tallapoosa Co. Ala 3. How long have you resided in the State of Texas? About 25 yrs 4. How long have you resided in the county of your present residence? And what is your postoffice address? About 25 yrs. Winters, Texas 5. What was your husband's full name? Samuel Young Johnston 6. What was the date of his death? Feby. 20th, 1901 7. In what State was your husband's command originally organized? Alabama 8. How long did your husband serve? If known to you, give date of enlistment and discharge 4yrs. Enlisted about May or June 1861. Came home 1865. 9. What was the name or letter of the company, or name or number of the battalion, regiment or batter of artillery in which your husband served? If he was transferred from one branch of service to another, give time of transfer, description of command and time of service Co. B, Regiment #47 Alabama, No Transfer 10. Name branch of service in which your husband served, whether infantry, cavalry, artillery or the navy, or if commissioned as an officer by the President, his rank and line of duty, or if detailed for special service, under the law of conscription, the nature of such service, and time of service. Infantry. No commission. No conscript, a volunteer 11. Have you transferred to others any property of any kind for the purpose of becoming a beneficiary under this law? AFFIDAVIT OF WITNESSES [Note.-There must be at least two credible witnesses.] THE STATE OF TEXAS County of Runnels Before me, M Kleberg, Jr., County Judge of Runnels County, State of Texas, on this day personally appeared J. T. Spain & T. D. Bishop who are personally known to me to be credible citizens, who, being by me duly sworn, on oath state that they personally know that Mrs. Lucinda J. Johnston, applicant for a pension as the widow of Samuel Y. Johnston deceased, is in truth and fact the widow of Samuel Y. Johnston deceased; that they personally know that she has not remarried since the death of her husband, for whose service in the army she claims a pension, and that they have no interest in this claim.

AFFIDAVIT OF WITNESSES (If possible, the two witnesses should have served with the applicant's husband in the army, and, if so, let them, or either of them, state it in their oath; also any information regarding the army services of applicant's husband.) THE STATE OF TEXAS County of Runnels Before me, M. Kleberg Jr. County Judge of Runnels County, State of Texas, on this day personally appeared J. T. Spain, who are personally known to me to be credible citizens, who, being by me sworn on oath state that they are personally acquainted with the forgoing applicant And further make oath to the following facts touching the service of the applicant's husband in the Confederate Army: (State fully your source of knowledge.) I knew Samuel Y Johnston in his lifetime He enlisted May 1861 and served to close of war. I know that he enlisted because I saw him leave for the war we were neighbors. Ihauled part of the way to Lochapoka, Ala where they boarded the train. His Co was Co B 47 Alabama so Ilearned while he was in the war that was the Co he was going to. He served honorably so far as Iknow. He never deserted his post of duty He was a volunteer. He was an infantryman. The State of Texas County of Runnels Before me, the undersigned authority, on this day personally appeared W. M. Golden, well known to me, and first being sworn upon oath deposes and says that I knew Samuel Y. Johnston in his life time. I personally knew him. I have known Samuel Johnston ever since he was a child. He was a cousin of mine. I knew him in Tallapoosa County, Ala. I personally knew that Samuel Johnston enlisted and served in the ARmy of the Confederacy. He performed the duties of a soldier. He enlisted in Co. B 47th Alabama. He enlisted in 1862 at Newfalla, Ala. He served till the close of the war. He was not commissioned by the President of the Confederate States as an officer. Nor was he a conscript. He was a volunteer. Samuel Johnston was in the same company with me and a mess mate of mine. There was no other soldier by that name serving in the same company and regiment of which I was a member. He served honorably from the date of his enlistment until the close of the war. He did not desert his command, or voluntarily abandon his post of duty or service during said war. I W. M. Golden, was sergeant of Co. B 47th Alabama Regiment, that is how I know that Samuel Johnston was a member of said Co. and Regiment. being sergeant, I saw Samuel all the time.

APPLICATION FOR MORTUARY WARRANT STATE OF TEXAS County of Runnels I, H.J. Butts do hereby certify that I am the person to whom is entrusted the paying of the accounts and indebtedness of the late Mrs. Lucinda J. Johnson, who was a pensioner of the State of Texas, and whose file number is 27938 and whose original county is Runnels The said pensioner Mrs. Lucinda J. Johnson, died on the 24th day of November, 1921, in the town of Winters County of Runnels, Texas. The pensioner died in the home of H. J. Butts who was related to the pensioner as mother in-law. That the warrant, which application is hereby made for, shal (sic) be applied to paying all or part of the expenses incurred by the said pensioner I further certify that the warrant for the current quarter has not been cashed by the pensioner, to the best of my knowledge and belief. CERTIFICATE OF UNDERTAKER I, Spill Bros. (by Ben), do certify that I am undertaker in the town of Winters, County of Runnels, State of Texas, that I had charge of the body of Mrs. Lucinda Johnson, who died in the town of Winters, County of Runnels, State of Tex. on the 24th day of Nov. 1921.That said body was prepared for burial by me on the 24 day of Nov., 1921. That said body was buried in the Winters Old Cemetery, which is located in the County of Runnels, State of Texas, and that I am of the opinion that warrant herein applied for should be issued to the said Mrs. Lucinda Johnson, who makes the foregoing application.

Sanders, do certify that I am a practicing physician, and that I attended Lucinda J Johnson in his last illness, and am of the opinion that her ailments were cancer of the face I further certify that I am of the opinion that the Mortuary Warrant above requested should be issued in the name of the aforementioned applicant, in accordance with Act passed by the Thirty-fifth Legislature, and approved March 2, 1917.
