APPLICATION OF Indigent widows of Soldier or Sailor of the late Confederacy for pension under the Act of May 12, 1899

To the Honorable County Judge of Runnels County, Texas.

Your petitioner, Mrs. Emiline Albert respectfully represents that she is a resident citizen of Runnels County in the State of Texas; that she is the widow of Mathew Albert, deceased, who was a Confederate soldier (or sailor), and that she makes this application for the purpose of obtaining a pension as the widow of said Mathew Albert, deceased, under the act passed by the Twenty-sixth Legislature of the State of Texas, and approved May 12, A.D. 1899, the same being an act entitled "An act to carry into effect the amendment to the Constitution of the State of Texas, providing that aid may be granted to disabled and dependent Confederate soldiers, sailors, and their widows under certain conditions, and to make an appropriation therefor," and I do solemnly swear that the answers I have given to the following questions are true.



NOTE-Applicant must make answer to all of the following questions and such answers must be written out plainly in ink.

Q. What is your name? Answer Emiline Albert

Q. What is your age? Answer Eighty two years old

Q. In what County do you reside? Answer Runnels County, Texas

Q. How long have you resided in said County and what is your psost office address? Answer Resided in Runnels County about seven years - Winters, Texas

Q. Have you applied for a pension under the Confederate Pension Law heretofore, and been rejected? If so state when and where. Answer I have never before applied

Q. What is your occupation if able to engage in one? Answer I am not able to ingage in occupation

Q. What is your physical condition? Answer I am very weak

Q. What was the name of your deceased husband? Answer Mathew Albert

Q. Were you married to him anterior to March 1, 1866? If so, on what date were you married to him and where? Answer I was married sixty years ago in the state of Illinois

Q. What was the date of his death? Answer He died in               1873

Q. Are you unmarried, and have you so remained unmarried since the death of your said husband for whose services you claim a pension? Answer I am unmarried & have so remained since his death.

Q. State in what company and regiment your deceased husband for whose services you claim a pension enlisted in the Confederate Army, and the time of his service therein? Answer Company A, 3rd regiment Missouri Cavalry - He served for during the whole war.

Q. If your ceceased husband served in the Confederate Navy, state when and where, and the time of such service? Answer --------------

Q. State whether or not you have received any pension or veteran donation land certificate under any previous law, and if you answer in the affirmative state what pension or veteran donation land certificate you have so received. Answer I have received none

Q. What real and personal property do you now own, and what is the present value of such property? Give list of such property and value. Answer I own nothing at all of any kind of property

Q. What property, and what was the value thereof have you sold or conveyed within two years prior to the date of this application? Answer I have sold nothing

Q. What income, if any, do you receive? Answer I receive no income at all

Q. Are you in indigent circumstances; that is are you in actual want, and destitute of property and means of subsistence? Answer I am strictly so

Q. Are you unable by your labor to earn a support? Answer I am most assuredly

Q. Have you transferred to others any property of value of any kind for the purpose of becoming a beneficiary under this law? Answer I have not

Q. Did your deceased husband for whose services you claim a pension ever desert the Confederacy? Answer No

Q. Have you been continuously since the first day of January March 1880, a bona fide resident citizen of this State? Answer I have been a resident of this state since 1863

Wherefore your petir prays that her application for pension be approved and that such other proceedings be had in the premises as are required by law.

Before me, C. H. Willingham County Judge of Runnels County, State of Texas, on this day personally appeared D. F. Lollar who are personally known to me to be credible citizens who being by me duly sworn on oath, state that they personally know that Mrs. Emiline Albert, applicant for a pension as the widow of Mathew Albert, deceased, is in truth and fact the widow of the said Mathew Albert, deceased; that they personally know that the said Mathew Albert, deceased enlisted in the service of the Confederacy, and performed the duties of a soldier (or sailor) as claimed by his said widow in the above and foregoing application and that they further know that the said Mrs. Emiline Albert, widow of the siad Mathew Albert, deceased, is unable to support herself by labor of any sort.

I, C.H. Willingham, County Judge of Runnels County, State of Texas, do hereby certify that on the 1st day of August A.D. 1899, before me came on to be heard the application of Mrs. Emiline Albert, widow of Mathew Albert, deceased, for a pension under the Confederate Pension Law of this State, approved May 12, A.D. 1899; that the answers of said applicant to the questions propounded were made under oath as the same appear in writing in the foregoing application; that the affidavits of the witnesses who are credible citizens were made before me as the same hereinbefore appear. I also certify that the said applicant Mrs Emiline Albert  is not disqualified uner any of the provisions of Section 12 of the Confederate Pension Law. I further certify that after considering all of the proceedings had before me relative to the said application for a pension by the said Mrs. Emiline Albert as widow of Mathew Albert deceased, I find the said applicant is lawfully entitled to the pension provided for by the Confederate Pension Law of this State, and I hereby approve said application.

We, the undersigned members of the Commissioners Court of Runnels County, Texas, hereby certify that the foregoing application of Mrs. Emilene Albert widow of Mathew Albert deceased, for a pension, together with the proof in support thereof, was duly submitted by Hon. C.H. Willingham County Judge of this Runnels County, to the Commissioners Court of this Runnels County, at a regular term thereof on the 15th day of August A.D. 1899, and after a careful consideration of the same we find the said applicant is lawfully entitled to the pension provided for by the Confederate Pension Law of this State, and we hereby approve said application.

You will take notice that five days after service of this notice and a copy of the accompanying interrogatories, the applicant herein will apply to the Clerk of the County Court of Runnels County Texas, for a commission to take the deposition of W. F. Mallory, who resides in Grayson County, Texas, in answer to the following interrogatories and such cross interrogatories as you may propound, said answers when so taken to be considered as evidence in support of the application of Mrs. Emiline Albert for a pensin, under and by virtue of the law passed by the a1st(sic) session of the Legislature.

1st Interrogatory.

What is your name, where do you reside, how long have you resided in the county where you now reside and what is your occupation?.

2nd Interrogatory

Were you or not, a Confederate soldier during the Civil war? If so, Where di you enlist as such soldier, in whose company or command did you serve and how long did you serve as such? Answer fully.

3rd Interrogatory

Did you or not ever know one Matthew Albert? If so when and where did you first become acquainted with him? Was he or not a Confederate Soldier? If so, When did he enlist and where did he enlist? In whose Company or Regiment did he belong or serve? How long did he serve and when and where was he discharged?

4th Interrogatory

If you have said that you knew Mathew Albert, then please state whether or not he is living, if living where does he reside, and if dead, state if you can, when and where he died?

5th Interrogary

If you have answered that you knew Matthew Albert and that he is dead, then state whether or not he was married at the time of his death and if yea, then state if you know when and to whom he was married, that is , if you can do so, give the date of his said marriage and where the same took place and give the name of his wife.

6th Interrogatory

If you have answered that you knew Matthew Albert that he is dead, that he left a widow surviving him and that her name is Emiline Albert, then please state whether or not she is living or dead, and if living where does she reside and state whether or not she is married or unmarried and if unmarried, state whether or not she has remained unmarried since the death of the said Matthew Arnold(sic), to the present time.?

7th Interrogatory

If you have answered that you know the widow of said Matthew Albert, then if you know, please tate whether or not she is able or unable to earn a support by her labor? What income, if any, has she? What if any property, real or personal, has she and what is its value, if any you say that she has? What are her circumstances financially? Is she in indigent circumstances, or otherwise? Answer fully? Is she or not a bone fide citizen of this State and if so, how long has she been such. Answer fully.

In the matter of application of Mrs. Emiline Albert widow, for Pension- Runnels County Texas.

I. N H.L. Decker a Notary Public in and for Grayson County Texas do certify that in virtue of the authoruty(sic) vested in me by law and by the interrogatories and cross interrogatories in the above mater and behalf and waiver all of which are hereto attached. I caused to come before me at my office in Grayson County Texas W.F. Mallory the witness in said papers named and he was by me duly sworn as required by law to speak the truth the whole truth and nothing but the truth in answer to said direct and cross interrogatories and the said Mallory witness thereupon deposes and testifies as follows.

In answer to the first interrogatory he says
My name is W.F. Mollory, I reside in Grayson County, Texas near Key postoffice and have resided in Grayson County Texas since 1865 with the exception of one year and I am a farmer by occupation.

In answer to the second interrogatory he says- Yes I was a Confederate soldier during the civil war. I enlisted in the state of Missouri Dade County in year 1862 and I think in the month of August I had already been in service in the state guard since beginning of the war I served in Company A third regiment Coffey's old regiment and served till the close of the war

In aswer to the third interrogatory he says - Yes I knew Matthew Albert and knew him from my earliest recollection and he was a Confederate soldier. He enlisted at the commencement of the war under General Price at Cowskin Prairie when Price recruited his army. He belonged and served in same command with me in Company A and in the state service in Co. H I think Clarkston's regiment He served till the close of the war and till we were dicharged at Shreveport La.

In answer to the fourth interrogatory he says
Matthew Albert is dead-He died here in Grayson County Texas and my recollection is he died from 1870 to 1875.

In answer to the fifth interroagory he says
Yes Mathew Albert was married at the time of his death - he was married to Emiline Dronn or Drun I think was her name. he was married to her when I first knew him and before I can remember I cannot give the date of marriage for they were married at the time of my earliest recollection they then lived in Dade County Missouri

In answer to the sixth interrogatory he says
Yes Mathew Albert left a widow Emiline. She is now living in Runnels County Texas - She is still unmarried and has so remained unmarried since the death of Mathew Albert-

In answer to the seventh interrogatory he says
When I knew her Emiline she had nothing no means of support - not able to earn a support by her labor - no income and physically feeble and unable to work and with no property - she is now and has been a citizen of the State of Texas since 1862 or 1863.

In answer to answer to first cross interrogatory he says-
Yes Mathew Albert lived in Tesxas. His wife refugeed here in 1862 or 1863 having been burned out in Missouri and Mathew came here to Texas at the close of the war in 1865 and lived here till he died-

In answer to the second cross interrogatory he says
My answers heretofore given will answer this question - Mathew Albert did come to Texas and died here in Grayson County before 1880 Elminline(sic) come here in 1862 or 1863 as I recollect and have stated and lived here in Grayson County till about eight years ago I think

In answer to the third cross interrogatory he says-
Mathew Albert served in the war from its beginning till the close of the war - He never deserted but stayed with command.

In answer to the fourth cross interrogatory he says
He served only as a private solder so far as I know -

In answer to the fifth cross interrogatory he says -

I come from Dade County Missorui came to Texas while in the Army in 1862 and then again at the close of the war and lived here since - I have seen both the applicant and her deceased husband while he lived - knew them in Missouri from my earliest recollection and here in Texas - as stated in my answers above given -
