This is a transcription of Book B of the "Minutes of the Commissioner's Court of Kaufman County".  Since only pages 1 through 92 were located, these are the only ones transcribed.

To remain consistent with the index to the Minutes which is located in the County Clerk's Office, the numbering of the original pages will be indicated in the text.
Lines of the original text which were deleted will be placed in parentheses and underlined.
Deleted material which is so unclear as to force the transcriber to "figure it out" will be indicated by a "carrot top", ^.
Comments of the transcriber will also be placed in brackets.

To make reading easier here, the different PAGES and ORDERS have been separated and placed on sequential lines - the original text is written continuously on every page.

Wednesday: June 22nd AD 1853
County Court met In [blank] Session Members present. John C. McCorquodale Chf Justice-- W D Irvine & A M Cobb Co. Comm. James Eagan Shff-- and S. E. Noble clerk.
Court was opened in Regular form by proclamation of the Sheriff-- When the following proceedings were had-- To wit-Prect. 19. 2nd class road Order 1st Ordered by the court that Road Precinct No 19. be changed So as to commence at a bridge on Kings Creek near R. S. Wilsons, Thence East 1 mile. Thence North to the line of' Hunt County Thence west with said line to the South west corner of said County. Thence South so as to include E P & J H M Chisholm Thence to the McCarty crossing near the Campground on Said Creek. Thence to the place of' beginning. And it farther [sic] ordered that James L Alexander be and he is hereby appointed Overseer to work under his supervision all the hand [sic]included within the limits of said Precinct

   Order 2. This day comes into open court J H M Chisholm Assessor & Collector of Taxes for Kaufman County and made a full and complete exhibit of the assessment of all the property of said county for the Year 1853 to the satisfaction of the Court Order

Kaufman Texas August Term AD 1853
County Court met in Regular Session Members Present. Hon- John C McCorquodale. presiding Nathaniel Dougherty A M Cobb & W D Irvine Commissioners James Eagan Sheriff by his Deputy Obed. Vanpool & S E Noble clerk Court was opened in legal form by proclamation of the Sheriff when the following proceeding [sic] were had. To Wit.First Order. Ordered by the Court that J W Boles James Daugherty   Albert  Hendricks   Ephraim Goss & M_____ Yates be and are they are hereby appointed a Road committee to view & mark a road-- Beginning at the Town of Trinidad and to Run on the nearest practicable Route (to) in a direction to Wells ferry on the East fork of Trinity River ^^to the county line^^ and they be Requested to Report to the next Term of Court2nd Ordered by the Court that the claim of Abner Johnson. This day presented against the county-- amounting to $12.00 for Books and Stationary [sic] furnished the court pr order of A Baird Depty Clerk during the Years 1849 and 1850 be allowed; and that the clerk issue and order upon the Tresurer [ sic ] for the same [on the left margin] Issued Adj. November Term AD 1853 Mondy [sic] 21st
County Court: met in Regular Session Members Present: Hon. J. C. McCorquodale presiding S. R. Barnes. Nath Daugherty. A M Cobb and W D Irvine Commissioners. James Eagan Sheriff and S E Noble Clerk. Court was duly opened by proclamation of the Sheriff. When the following proceeding [sic] were had-. To Wit---First order Ordered by the Court that the sum of twenty nine dollars be allowed Abner Johnson for Books furnished for the use of the County and District Courts [in left margin] Jun 21 1858 issued

  Second-- Ordered that Glover Wells be allowed and he is hereby authorized to keep a toll Bridge on the Bois d arc or E fork of Trinity and it be farther [sic] ordered that the said Wells be allowed to charge the following rate of Toll. Viz. For man & horse-- 10 ct Footman 5 cents. 1 Horse carriage 25 2 horse waggon 50 cents. 4 horse or 4 ox teams and waggon 75 cents-- 4 yoke cattle and waggon $1.00. Sheep hogs or goats 2 cts each CattIe or horses 5 cents pr head

  Third. This day comes into open court Samuel E Pyle and John Pyle Representative of Simeon F Pyle deceased and made application for their unconditional land certificates and it appearing to the satisfaction of the Court that each of them had received [ sic ] their conditional certificates and complied with the conditions there of &c It is therefore ordered by the Court that an unconditional certificate for 320 acres of Land issue to each of them

  Fourth. This day comes James Wilson into Court and proposes to the Court to transcribe the Records Relative to the Surveys of Land

in Kaufman County and now on Record in the office of the Surveyor of Nacogdoches Land District-- for the sum of eight cents pr hundred words for transcribing and sixty five dollars or comparing the same with the original One half of the amount to be paid him when the said work is finished and certified to by said District Surveyor and approved by aforesaid Court and the Remaining balance at the expiration of twelve months from the date of said approval. It is therefore ordered adjudged and decreed by the Court that said proposition be and the same is hereby accepted by the Court--and that the said James Wilson be and he is hereby authorized to proceed with said work at his earliest convenience   And be it further ordered that said James Wilson be furnished with a certified copy of this order by the .clerk of said court.

  Fifth Ordered by the Court that the Treasurer of this county be Required to retain in his hands one hundred and fifty dollars of the State Tax to be appropriated to the payment of Transcribing the Record pertaining to the Surveys of Lands of this county the Said amount to be subJect to the further order of this court

  Sixth. Ordered by the Court that James Wilson be allowed to draw upon the Treasurer of this county for the sum of Ten dollars to purchase stationary [sic] to be used by him in making transcript of Surveys of said county  Seventh Ordered that the court AdJourn till tomorrow morning. 9 oclock

Tuesday Morning Nov 22nd
Court met pursuant to Adjournment Members present as on yesterday. Court was duly opened by proclamation of the Sheriff-- When the following proceedings were had. To Wit.

  First. Ordered by the Court that Obed Vanpool be and his is hereby appointed Presiding officer of Elections in Precinct. No 3

  Second. This day James Eagan Sheriff of Kaufman County made application for Exofficio Services and it appearing to the Satisfaction of the Court that Said claim is just. It is therefore ordered that he be allowed the sum of fifty dollars for his said exofficio services from the third monday [sic] in August AD 1852 till the third monday [sic] in August AD 1853-----[ in left margin ] Issued  

  Third--. Ordered by the Court that Obed Vanpool Constable be allocated the Sum of nine dollars for Services rendered by him at the spring and Fall Term ^^1853^^ of the District Court of Kaufman County------------[in left margin] Issued May 31 1858

  Fourth. Ordered by the Court that the sum of eight dollars & Eighty two cents be Refunded by the Treasurer to J M H Chisholm that amount being paid by him on non Resident property which was paid in another county

  Fifth Ordered by the Court that S E Noble and James T Rayel be and they are hereby Authorized to transcribe in a well bound Book all the Records contained in a paper Book called. A. which is a Record of deed Patents &c. for which services the said Noble & Rayel are to Recieve [ sic ] pay at the Rates of eight cents pr hundred words to be paid out of any money in the hands of

  Sixth Ordered by the Court that an order passed at the May Term of Said Court 1853 which order is in the following words. to wit. "It is ordered by the Court that henceforth the Claims against the County Shall be liquidated by the Treasurer according to the date of issue the Senior claims having in all cases the preference: and that he be required to Keep a Register in which all the claims presented Shall be Registered" be amended so as to Read as follows.

  7th Ordered by the Court that all Claims against the County Shall be liquidated by the Treasurer according to the date of issue the oldest claim having the preference except in certain cases which may in the discretion ^^of the court^^ be for the immediate benefit and interest of the county7th Ordered by the Court that A M Cobb be allowed the sum of Sixteen dollars and fifty cents for his services as Co. Commissioner from February AD 1852 up to the present time[in left margin] issued

Be it Remembered that on this Twenty first day of August AD. 1854 there was begun and holden a regular term of the Honorable County Court in and for the County of Kaufman at the Court house thereof. Present the Hon. John C. McCorquodale chief Justice, G. N. Sawyer William Johnson & John Butler Commissioners, S. E. Noble Clerk of said Court and S. O. Gibbs Sheriff of said County.  Whereupon the fallowing orders were had and entered,The petition of. William Lewis and. others was presented praying for a Road Leading direct from Kaufman (direct) to Black Jack grove in Hunt County Texas. It is Considered and ordered by the Court that James Cummins Lewis Jordan, James Eagan, Andrew Henry, W. W.    Ordered by the Court that A. H. Henry, Thomas J. Lewis Isaac Houston, James Cummins and Lewis Jordan be and they are hereby appointed reviewers to mark and review a road from the town of Kaufman to black jack grove [The following word is in parentheses and underlined in the original] (direct); and that said Reviewers meet at the house of A. This day comes Joel Boyd and represents to the Court that Wesley Ward is an idiot and incapable of supporting himself. It is therefore ordered by the Court that Joel Boyd be and he is hereby authorized to take the said Ward into custody and take such measures for the safe keeping of said Ward as may Seem best in his judgment; and be it further Ordered that Joel Boyd be allowed the sum of twelve Dollars and fifty cents per month for keeping said Ward to be paid out of the County Treasury of Said County of Kaufman.Ordered that Court adjourn until the 30th day of June next. Be it Known that on this 5th day of July A. D. one thousand eight hundred and fifty six there was begun and holden at the Court house in the town of Kaufman a called term of the Hon. County CourtPresent & presiding the Hon. John C. McCorquodale Chief Justice of said Kaufman County, S. E. Noble Clerk of said Court John M. Watkins and William Johnson Commissioners of Kaufman County and S. 0. Gibbs Sheriff of said county..Whereupon the following proceedings were had.

   1st Ordered by the Court that Abner Johnson be and he is hereby allowed the sum of Thirteen Dollars for Books bought by him for the use of the County[in left margin] Issued

   2nd Ordered by the County Court that Jas H. Raymond Treasurer of the State be and he is hereby authorized to pay the sum of Eleven Hundred and Nine Dollars, it being the amount due Kaufman County for School purposes, Said amount to be paid to the Treasurer of the County of Kaufman.3rd Ordered by the Court that S. O. Gibbs be and and [sic] he is hereby allowed the sum of Eight Dollars and fifty cents Being the amount he paid to J. R. Rierson as board of Guard for the safe Keeping of A. M.    Abner Johnson Presented the petition of M E Bonds and others praying for a Road Commencing on the East bank of the Trinity River opposite McKeary's Mill seat running thence to the county line of Kaufman county in the Direction of Tyler. It appearing to the Satisfaction of the Court that the Legal notices had been posted  It was therefore ordered by the Court that Said petition be granted and that M E Bonds  John H Sutton   J McMorris   Sam Pyles and Thomas Seitz be and they are hereby appointed a board of Road commissioners to view and mark out Said Road[in left margin] issued 10th Oct 1856Ordered that Court adjourn til tomorrow morning, 9 o'clock

Thursday Morning Aug 19th 1856
Court met persuant [sic] to adjournment  Members Present as on yesterday(And now come William Johnson into Court and presents an account against the County of Kaufman for Stationary purchased by him in the City of New Orleans for the use of the County and district Courts of said County amounting to the sum of forty Dollars and fifty Cents ($40 50/100) And it appearing to the Satisfaction of the Court that said Stationery was lost by the sinking of the boat which had the Same on board; with the Exception of Six Bottles ink the cost of which amounts to fifty cents per bottle and freight charges amounting to the sum of four Dollar & fifty Cents. It is therefore considered by the court that the said account be and the same is hereby rejected with the exception of the said four dollars and fifty cents)[marked through the order] Null and Void by order of the Court
  It is ordered by the Court that William Johnson be and he is hereby allowed the sum of four Dollars and fifty Cents For six Bottles of Ink furnished the County and District Courts of Kaufman County([in left margin] issued Ordered by the Court that William D. Irvine be and he is hereby allowed the sum of ten Dollars and fifty cents for seven days Services as one of the commissioners of Kaufman County.
